These conditions govern access to and use of Newton County Criminal History. Reading its content, opening a page, or submitting a search signifies agreement to every term below. Anyone who does not agree must stop using the website.

NO FCRA USE. Newton County Criminal History is a private website with no government connection. The website and its advertising partners do not offer services for credit, employment, insurance, tenant, or other screening regulated by the Fair Credit Reporting Act (FCRA). It is an Arkansas records directory, not a consumer reporting agency or private investigator.

1. What This Website Is

This is a privately run reference resource, independent of every government agency. It neither stores official criminal records nor obtains official checks, retrieves files, or submits documents for users.

Its purpose is to point readers toward the custodians of Newton County records, such as the sheriff, Arkansas courts, Arkansas State Police, and Arkansas Sex Offender Registry, along with outside research tools. Access to non-exempt local records may be governed by the Arkansas Freedom of Information Act, Ark. Code Ann. § 25-19-101 et seq.; Arkansas repository dissemination is governed by Ark. Code Ann. § 12-12-1501 et seq.

2. Rules for Using This Site

As a condition of access, users must not:

  • Use automated scrapers, bots, or similar tools on the pages
  • Violate a federal, Arkansas, or local law through the website
  • Attempt unauthorized entry into any website system
  • Use information to threaten, stalk, or harass another person
  • Rely on website content for lending, insurance, housing, or hiring decisions
  • Interfere with performance or prevent access by other visitors

3. No Harassment, Stalking, or Discrimination

Neither website content nor information reached through a link may be used for harassment, stalking, threats, intimidation, or discrimination. Ark. Code Ann. § 12-12-913 permits disclosure of Arkansas registry information for lawful awareness and public safety. Disclosure does not authorize vigilantism or illegal conduct toward a registrant.

4. We Are Not a Consumer Reporting Agency

Newton County Criminal History is not a consumer reporting agency under the FCRA. It does not create credit reports, background checks, or any other consumer report. Its advertising partners likewise do not provide tools intended to assess job candidates, rental applicants, insurance risk, or creditworthiness. Users agree that neither website data nor a linked tool will be used to:

  • Evaluate a person for a license, permit, or public benefit
  • Make an employment decision
  • Set insurance terms or evaluate creditworthiness
  • Review a person for housing or a lease
  • Carry out any other activity regulated by the FCRA

When an FCRA-regulated purpose lawfully calls for a check, use Arkansas State Police or a qualified provider that complies with the FCRA.

5. No Legal Advice

Website material is general information, not legal advice. It cannot resolve how a warrant, charge, conviction, or Arkansas sealing rule applies to specific facts. Questions about an individual matter belong with a licensed Arkansas attorney.

6. No Warranties

All services and content are supplied "as is." No promise is made that:

  • A partner's search result will be complete or correct
  • The website will remain continuously available
  • Content will always be accurate, current, and complete
  • The pages contain no bug, error, or security weakness

Criminal records can change when charges are filed or dismissed and when records are sealed. Updates may not appear at once, and omissions can occur. No content here is an official statement by a sheriff, court, or other government body.

7. Third-Party Services and Links

Links lead to outside services, including sheriff pages, court portals, Arkansas agencies, legal-aid resources, and search providers. Newton County Criminal History does not control those destinations. It bears no responsibility for their availability, charges, privacy practices, or content. Visitors should examine each provider's terms before use.

8. Intellectual Property

Newton County Criminal History or its content partners own the website's text, code, graphics, and logos. Prior written approval is required to copy, alter, distribute, or create derivative material from them.

9. Limits on Our Liability

To the maximum extent permitted by law, the operator is not responsible for damages arising from website use, including harm tied to a decision based on content here or on an outside linked service.

10. Indemnification

Users agree to defend and hold the operator harmless from claims, demands, or proceedings caused by their website use or violation of these terms. This obligation includes related expenses and legal fees.

11. Governing Law

These terms are interpreted under Arkansas law. A dispute connected with the website must be filed in an Arkansas court.

12. Changes to These Terms

The operator may revise these conditions at any time. A revised version becomes effective when it is posted here.

13. Cutting Off Access

Access may be suspended, limited, or terminated at any time, without advance notice and for any reason.

14. Severability

If one provision is held invalid or unenforceable, all remaining provisions continue in force. The affected language will be modified only to the degree needed for enforceability.
